RENTAL HOUSING REGISTRY

 

 

By publication and posting of this notice, all property owners in the Town of Charlotte are hereby notified of the requirement to register any dwelling unit or portion thereof that is held out for rental.  State law, Title 21 of the Vermont Statutes Annotated, Section 251 (a) defines as a public building any building in which people rent accommodations, whether overnight or for a longer term.  Public buildings in Vermont are required by law to obtain an Occupancy Permit from the Department of Labor and Industry, Division of Fire Safety and Prevention.  Failure to obtain such a permit is a violation of state law and subjects the property owner to possible fines, penalties, and suspension of rental privileges.  Money need not change hands in a rental situation for the public building codes to apply.  Compensation in exchange for shelter may take any form, including, but not limited to work, care, tutorial assistance, management, security, etc.

 

The Town of Charlotte has established a rental property registry.  A form for registration of your rental property is available at the town offices or on-line at the town website (http://vermont-towns.org/charlotte).  There is no fee for registration of your rental property.  A rental property owner must attach a copy of the Occupancy Permit issued to them by the state Department of Labor and Industry for the subject rental unit.  Any known rental properties, not registered with the town and permitted by the state as of January 1, 2005, will be reported to the state for enforcement action by the appropriate authority.  Rental housing for farm workers, while exempt from local permitting requirements, must still meet the state fire safety and prevention code, obtain an Occupancy Permit, and register with the Town of Charlotte.
