1. General Business, approve Minutes: Al Moraska noted that members who were present for
the meetings that were to be approved, needed to be here to vote, so these were postponed.

2. Town Plan: There had been a work session on the previous Monday.

3. Michael Lazar, 1196 Lime Kiln Road, changes in use for a private elementary school,
Site Plan Review (when Mike came in at previous meeting it was a Sketch Plan): Mike Lazar said
after talking with Louis Cox to try to see that he had everything in order he had obtained State
waste water approval, State water approval, Board of Education approval, and the Dept. of Health
approval. Then at the Sketch Plan hearing in June, he was asked to meet with Fire Chief Chris
Davis, who suggested a meeting with the Fire Marshall in Williston. He, in turn, asked Mike to get in
touch with Labor & Industry. 

Labor & Industry's representative came out to see it, and their requirement is that the whole building
be built to Labor & Industry's code. He has 2 fire extinguishers and a 1/2" firewall, for instance, but
L&I requires a 5/8" firewall. But the building has already been done. Mike said they had told him
there may be a way that he could classify this so that it would be acceptable. There is a classification
of a Registered Daycare license that he could use, they told him. Otherwise he would have to install
an elevator for the loft where he has planned a library, and add handicap access for wheelchairs,
add insulation and other things that are not feasible. He could homeschool and hire a teacher, but
only for his two children and an additional two children only. So as of today he is still working on a
solution.

Mike explained that this is a recognized school. You send in all the materials and comply with what
they require. But the State Education Department apparently doesn't go to Labor & Industry to see
what additional details must be followed in the construction. 

Al Moraska said in their Site Plan Review they look at vehicular traffic and fire safety. How thick
the firewall is, doesn't concern the Planning Commission. Aesthetics, natural features, water and
sewage appear to have been addressed. Jim Donovan noted that the Home Occupation use may
limit the vehicular traffic to 12 trips per day on average. Mike said he doesn't expect there will be
more than that. 

Ed Melby moved that they approve the Lazar Site Plan Review application. Jim Donovan
asked to add the condition that there be an average of 12 vehicular trips per day. David
Woolf seconded the amendment and the vote was 4-0 on the amendment. Then Al Moraska
seconded the whole motion, and the motion was approved, 4-0 with two members absent.

4. Other Business: Jim reported that the Selectboard now has 3 applications to fill the Planning
member vacancy. All applicants were qualified, but names of the applicants are a personnel matter,
however, so this is not recorded.
